A new bill has been introduced in Congress which, if passed, will prevent the FDA from banning 99.9% vapour products next year. 

The cross-party draft law - known as the FDA Deeming Authority Clarification Act of 2017  - was tabled Thursday by Tom Cole (R-OK) and Sandford Bishop (D-GA) and is now gaining traction in Washington. If the bill passes it will move what is known as the "predicate date" for vapour products; all those that were on the market on 8 August 2016 would not now be subjected to a regulatory system so overbearing it amounts to a ban due to its cost and complexity.

True to their word, FDA have conducted their first sting operations on both brick and mortar and online stores, sending kids to attempt to purchase newly regulated products and issuing sternly worded letters to any vendor who let them.

In their letters, FDA warn companies about the provisions that vapour products are now subject to:

“FDA has determined that your e-liquid is misbranded under section 903(a)(7)(B) of the FD&C Act (21 U.S.C. § 387c(a)(7)(B)) because you sold this product to a person younger than 18 years of age” the letters begin.

Coming at a time of year when sensationalist rhetoric threatens to undermine quit attempts around the globe, Public Health England (PHE) has once again shown itself as a voice of reason, and the driving force behind making the UK the most vape friendly place in the world.

The main findings

Stanton Glantz has been sued for sexual harassment by a former postdoctoral researcher at the University of California, San Francisco, Buzzfeed reports.

In a year that has seen high profile stars such as Kevin Spacey and Harvey Weinstein accused of serious sexual crimes, Glantz – an outspoken critic of vaping – has been accused of forcing his former subordinate to hug her, repeatedly staring at her body, and displaying “misogynistic and racially insensitive behaviour”.

Glantz's accuser, Eunice Neely, claims that she was forced to leave UCSF due to his actions and the inability or unwillingness of the University to address them. She left her job in 2017.

In late 2016, Neely claims that Glantz described an orgy scene from a film while the pair were alone in a dimly lit room. The complainant had never seen the film in question, but Glantz assumed she had watched it because all of the main characters were black.

She also claims that Glantz had told students

The British Government has started a crackdown on eliquid that is packaged like well known food products, yanking products from shelves including some that are designed to look like Krispy Kreme doughnuts.

Trading Standards - the UK Government Agency that enforces the law on consumer products - removed six different brands of eliquid including Murica, which is presented in a box identical to a McDonalds apple pie; and Krispy Vape, which is presented in a Krispy Kreme style box. Other brands removed from sale included Milky Cones, Milkshake Man and Drippy Lee Pounding Clouds.

A spokesman for the local Council, which oversees trading standards, said:

“I’m pleased that our Trading Standards team have investigated and removed these potentially harmful products from sale in Knowsley.

The safety of customers is always our highest priority and I’m concerned that young children could be attracted to these products because of their appearance.
